Overview

The Youth Criminal Justice Act (YCJA) governs how the Canadian legal system treats young people aged 12 to 17 who are accused of criminal offences. The YCJA recognizes that youth have unique needs and that rehabilitation — not punishment — should be the primary goal. However, young persons still face serious consequences, including custody, probation, and in extreme cases, adult sentences.

Navigating the youth criminal justice system requires specialized knowledge and a sensitive approach. Parents and guardians are understandably anxious, and the young person is often confused and frightened. At Batish Law, we provide compassionate, age-appropriate representation that respects the dignity of the young person while vigorously defending their rights.

Our lawyers are experienced in all aspects of youth criminal defence — from extrajudicial measures and diversion programs to contested trials and sentencing. We work to keep your child's record clean, minimize the disruption to their education and personal development, and secure the most favourable outcome the law allows.

What's at Stake

Youth sentences under the YCJA are generally less severe than adult sentences but can still include custody and supervision orders of up to three years for most offences, and up to ten years for the most serious crimes. Young persons can receive adult sentences for certain offences committed after age 14. Youth records are sealed but not automatically destroyed — the retention period depends on the nature of the offence and the sentence imposed.
